The state of Michigan dismissed the appeal from Monday, Nov. 8 in a decision that once again permits Edenville flooding cases to go ahead, according to a news release from a law firm representing victims.

In May, a judicial trial judge denied a motion from the state to dismiss residents' cases, writing that the states governmental immunity does not apply to inverse condemnation, the claim sparked by the lawsuits. Now the appeals court has denied the states appeal, the case will return to the tribunal of Claims for future proceedings, according to a news release from Ven Johnson Law.
